For clients contracting Dronesurvey Asia for specific aerial projects, missions and services flown in Hong Kong or Macau, the following Terms and Conditions apply. Acceptance of any quote or proposal issued by or on behalf of Dronesurvey Asia, indicates full acceptance of these Terms and Conditions. Please read these Terms carefully, as they also contain important operational safety information.
- Mission Preparation I: All missions and drone flight locations are subject to approval and issue of a permit to operate by the Hong Kong Civil Aviation Department (CAD) or Macau AACM. The CAD/AACM may grant permission to operate, but with additional requirements and provisos that cannot be anticipated beforehand. This in turn may affect the overall cost of mission preparation, and such costs will be made clear to the client by Dronesurvey Asia as they occur. Dronesurvey Asia will do its utmost to fulfil the requirements laid down by the CAD/AACM, but Dronesurvey Asia makes no guarantee or warranty that a specific mission / location to operate will be approved by the CAD.
- Mission Preparation II: Dronesurvey Asia may, at its discretion, decide not to take on a drone mission following the pre-site survey and risk assessment of the location in question. If Dronesurvey Asia considers the risk factors to be too high, and/or client requirements for deliverables of the site are considered unobtainable without considerable risks being incurred, then Dronesurvey Asia would advise against the use of drones over and around said site / location. The client agrees to paying a fee equivalent to 50 percent of the Mission Prep fee, to cover work and time spent up to that point.
- Mission Execution (Drone flight) I: On the day of the flight, Dronesurvey Asia will provide a minimum 2-man crew, consisting of a Pilot-in-Command (responsible for flying and operating the aircraft), and an Observer/Spotter (responsible for observing the aircraft and surroundings while in flight, warning the pilot or any potential incursions or dangers around the flight area, and keeping the take-off / landing area clear at all times). The Pilot-in-Command is responsible for the safe execution of the mission at all times. All persons in and around the take-off / landing area must follow the instructions of the Pilot-in-Command and/or Observer/Spotter at all times. This includes (but is not limited to) representatives of the client, the client’s own client, and representatives of other contractors or interested parties on site.
- Mission Execution (Drone flight) II: Upon setup of the take-off / landing area, the Pilot-in-Command will hold a flight safety briefing session at the site. Any and all representatives of the client on site, plus representatives of other contractors on site (project managers, site foremen, etc) must attend the briefing session, and be fully aware of the mission (flight) plan, objectives, as well as safety precautions and other matters pertaining to safe operation of the aircraft over the location.
- Mission Execution (Drone flight) III: The client agrees and understands that the Pilot-in-Command has full discretion at all times to delay, postpone or cancel drone flights altogether, if he or she deems it unsafe to do so. Factors that may delay or cause the cancellation of one or more flights include (but are not limited to) adverse weather conditions – wind, rain, typhoon signals, etc. – radio frequency interference, GPS satellite interference, or incursions by other aircraft (including other drones) into the location area.
- Mission Execution (Drone flight) IV: It is assumed that the Mission Execution can be completed within one to two full days, conducting one or more drone flights in that time period in order complete the job specification objectives. One full day is defined as a standard 8-hour day, operating during normal daylight hours. The client understands that additional Mission Execution charges may be incurred if (due to any of the circumstances outlined in item 5 above) additional days are needed to complete the job specification.
- Mission Execution (Drone flight) V: With regards to “Orthomosaic Map / 3D Model Capture” the client understands that the ability to capture sufficient oblique images around a site or location in order to render an accurate 3D model, may be restricted or limited by existing obstructions, structures, or other hazards in or around the flight location. Dronesurvey Asia will endeavour to capture as many oblique images as possible in order to achieve an accurate rendering, but cannot guarantee that all angles can be covered.
- Site Area: All fees are based on a flight area covering a location up to 12 hectares (29 acres) in overall size. Part 1 and Part 2 fees for sites over 12 hectares will be quoted separately.
- Payment Terms: The Mission Preparation fee and half of the Mission Execution fee are also the deposit. The total of two is due in full at that start of the project. All other fees are due in full in delivery of final data and materials.
- For Hong Kong: Dronesurvey Asia is a limited company registered in Hong Kong, under the full name STRONG NATURE LIMITED T/A DRONESURVEY ASIA.
- For Macau: Dronesurvey Asia is a limited company registered in Macau, under the full name DRONESURVEY ASIA LIMITED, or DRONESURVEY ASIA LIMITADA.
- All final billing will be based on final agreed project requirements and job specifications. Changes to specifications may result in additional costs, which will be quoted separately. Additional out-of-pocket expenses incurred, such as courier fees, will also be billed separately.
